Terms & Conditions

Please read these terms carefully before engaging our buyer's agent services.

1. Agreement to Terms

By engaging the services of Wagga Wagga Buyers Agency (ABN 12 345 678 901), you agree to be bound by these Terms and Conditions. If you don't agree to these terms, you must not use our services. These terms constitute a binding agreement between you ("the Client") and Wagga Wagga Buyers Agency ("the Agency", "we", "us", or "our").

We reserve the right to refuse service to any prospective client at our sole discretion.

2. Services Description

Wagga Wagga Buyers Agency provides property buyer's agent services including, but not limited to:

  • Property search and identification based on client-specified criteria
  • Property appraisals and market analysis
  • Attendance at property inspections on behalf of the client
  • Negotiation of purchase price and contract terms
  • Auction bidding services
  • Due diligence coordination including building and pest inspections
  • Settlement support and liaison with solicitors and conveyancers

The specific scope of services will be outlined in a separate Buyer's Agency Agreement signed by both parties prior to the commencement of any engagement.

3. Fees and Payment

Our fee structure will be detailed in the Buyer's Agency Agreement and may include a combination of:

  • Engagement fee: A non-refundable upfront fee payable upon signing the Buyer's Agency Agreement to commence the property search.
  • Success fee: A fee payable upon the successful purchase of a property, calculated as either a fixed amount or a percentage of the purchase price, as agreed in writing.
  • Auction registration fee: An additional fee may apply for auction bidding services where applicable.

All fees are quoted in Australian dollars and are inclusive of GST unless otherwise stated. Payment is due within 7 days of invoice unless alternative arrangements have been agreed in writing. Late payments may incur interest at a rate of 2% per month on the outstanding balance.

4. Client Obligations

As a client of Wagga Wagga Buyers Agency, you agree to:

  • Provide accurate and complete information regarding your property requirements, financial position, and purchasing capacity
  • Obtain pre-approval for finance prior to engaging our services, or provide evidence of available funds for a cash purchase
  • Respond to communications in a timely manner, particularly during negotiations and settlement periods
  • Not engage another buyer's agent for the same property search during the term of our agreement
  • Disclose any conflicts of interest or relationships with vendors, agents, or properties under consideration
  • Pay all fees and charges as outlined in the Buyer's Agency Agreement by their due dates

5. Limitation of Liability

While Wagga Wagga Buyers Agency will exercise due care, skill, and diligence in providing our services, we don't guarantee any specific outcome, including but not limited to the successful purchase of a property, future property values, or rental yields.

To the maximum extent permitted by law, our total liability arising from or in connection with our services is limited to the total fees paid by the client under the applicable Buyer's Agency Agreement.

We aren't liable for any indirect, consequential, or incidental losses, including loss of profit, loss of opportunity, or loss arising from reliance on information provided by third parties such as vendors, selling agents, or building inspectors.

Nothing in these terms excludes or limits liability that can't be excluded or limited under Australian Consumer Law.

6. Dispute Resolution

In the event of a dispute arising from or in connection with these terms or our services, the parties agree to follow this process:

  • Negotiation: The parties will attempt to resolve the dispute through good-faith negotiation within 14 days of written notice of the dispute.
  • Mediation: If negotiation is unsuccessful, the parties will submit the dispute to mediation administered by a mutually agreed mediator, or failing agreement, a mediator appointed by the Resolution Institute. The costs of mediation will be shared equally.
  • Litigation: If mediation doesn't resolve the dispute within 30 days, either party may pursue the matter through the courts of New South Wales.

7. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of New South Wales, Australia. The parties submit to the exclusive jurisdiction of the courts of New South Wales and any courts that may hear appeals from those courts.

Our services are provided in accordance with the Property and Stock Agents Act 2002 (NSW) and the Property and Stock Agents Regulation 2022 (NSW).

8. Changes to Terms

We reserve the right to update or modify these Terms and Conditions at any time. Changes will be effective upon publication on this website. Your continued use of our services after any modification constitutes acceptance of the revised terms.

For existing clients under a signed Buyer's Agency Agreement, changes to these general terms won't override the specific terms of that agreement unless both parties consent in writing.
